Sirius Case Status Update

In November 2009, Campbell Law, as co-counsel with two (2) other Florida law firms, filed a lawsuit against Sirius/XM Radio in the United States District Court for the Southern District of New York, Manhattan Division.  This class action lawsuit seeks to recover a $2.00 invoice administration inadvertently paid by class member subscribers when making payment for satellite subscription service by means other than personal check and/or money order.  In December 2010, after more than one year of protracted motion practice, and without benefit discovery, the court prematurely dismissed the class action complaint, following which in January 2011 Campbell Law and its co-counsel filed an appeal in the United States Court of Appeals for the Second Circuit.  Briefing should be completed by the end of the summer, following which we expect a ruling from the appellate court sometime in the fall.  Please check back for further updates.
